Terms of Service

Last updated: April 2025 · Effective immediately upon purchase.

Summary (not a substitute for reading the full terms): You pay $1 per pixel. Your pixel is permanently recorded in the artwork. Your dedication message is displayed publicly unless you set it to private. This is not an investment. Payments are via Stripe and are non-refundable.

1. What you are purchasing

When you pay $1 USD per pixel on The Human Canvas, you are making a contribution to a collaborative digital artwork. You are purchasing the right to assign a color and leave a dedication message associated with a specific pixel coordinate. You are not purchasing ownership of the full artwork, intellectual property rights over the combined work, or any financial instrument, token, or asset. This is not an investment product.

2. Permanence of your contribution

Once confirmed, your pixel's color and coordinates are permanently recorded. We will not remove, overwrite, or reassign your pixel unless: (a) required by applicable law or a valid court order; (b) your dedication message violates our content policy (Section 4); (c) a critical technical migration requires pixel reassignment, in which case contributors will be notified and compensated. "Permanent" means as long as The Human Canvas project operates. We will provide at minimum 90 days' notice before any planned shutdown.

3. Payments

All payments are processed by Stripe, Inc. We do not store your payment card details. Each pixel costs exactly $1.00 USD. You may purchase up to 1,000 pixels in a single transaction. All sales are final. Refunds are not available after a purchase is confirmed, because your pixel is immediately incorporated into the live artwork. Stripe's own Terms of Service apply to payment processing.

4. Content policy

Your dedication message must not: — Contain hate speech, incitement to violence, or content targeting individuals or groups based on protected characteristics; — Include personally identifiable information of third parties without their consent; — Contain spam, advertising, or promotional content; — Violate applicable laws of the jurisdiction where the project operates. We reserve the right to redact or mark as private any message that violates this policy. The pixel itself (color and coordinates) will not be affected.

5. Privacy

Your public alias, country, and dedication message are visible to other visitors if you set them to "public." You can change visibility to "private" at any time from your profile. We collect: your payment information (processed by Stripe, not stored by us), your public alias, your message, and basic usage analytics. We do not sell your data to third parties. See our Privacy Policy for full details.

6. Intellectual property

The Human Canvas as a collective work is the property of the project. Individual contributors retain copyright over their dedication messages (text they wrote themselves). By submitting a dedication message, you grant The Human Canvas a perpetual, worldwide, royalty-free license to display that message as part of the artwork — in the online version, in potential physical exhibitions, in documentation, and in promotional materials about the project. You confirm you have the right to submit any content you provide.

7. Exhibition and display

The artwork is being built with the intention of potential exhibition at cultural institutions. No specific exhibition is guaranteed. If the artwork is exhibited (physically or digitally), your pixel and dedication may be displayed as part of it. You consent to this by completing a purchase. Museum display permission can be toggled per your dedication settings.

8. Limitation of liability

The Human Canvas is provided "as is." We make no guarantees about uptime, future platform availability, or museum exhibition outcomes. Our liability to you is limited to the amount you paid. We are not liable for indirect or consequential damages.

9. Changes to these terms

We may update these Terms. Significant changes will be communicated via the platform with at least 30 days' notice. Continued use after the notice period constitutes acceptance. Your core right — that your pixel is permanently recorded — cannot be revoked by a terms update.
